SOFTCARE PRO TERMS & CONDITIONS

SOFTCARE PRO TERMS AND CONDITIONS
This document sets forth the terms and conditions between UBMicro and the Purchaser hereinafter referred to as End-user. No representation, promise or condition herein shall modify these terms. UBMicro is obligated to End-user to provide software services under these terms and conditions where in accordance with, and as allowed by state law.

ELIGIBILITY
Faculty, staff and students enrolled at a State University of New York University or College are eligible to participate. University departments and equipment purchased for the institution are not eligible to participate in SoftCare Pro. UBMicro reserves the right to determine if End-user and/or the computer purchased qualifies for participation.

PURCHASING AND PRICING
The standard purchase price of SoftCare Pro is $169 or the current promotional price. UBMicro reserves the right to change the purchase price at anytime without notice. SoftCare Pro can be purchased for a computer at the time of a qualifying software service. Occasionally, UBMicro will offer special promotional rates usually in conjunction with Back to School. In order to be eligible for any promotional pricing linked to a computer purchase from UBMicro, SoftCare Pro must be purchased at the time of the computer purchase. If SoftCare Pro is purchased at a later date for a computer purchased from UBMicro, the standard purchase price will apply. In order to be eligible for any promotional pricing linked to "bringing a new computer from home", the computer must have been purchased within sixty days, a valid proof of purchase for the computer must be presented at the time of SoftCare Pro purchase, and the computer must be free of present software problems or corruption. UBMicro reserves the right to charge a nominal fee of ¼ hour labor or one token to inspect new computers "brought from home" to verify the computer is presently free of any software problem or corruption in order to be eligible for the promotional rate. If a computer has a software problem or software corruption, the standard purchase price will apply. Computers purchased from UBMicro will qualify to purchase SoftCare Pro at the "bringing a new computer from home" rate and are subject to the above conditions for any "bringing a computer from home" promotion. After the ending date of any promotion, the standard purchase price will apply.

COVERAGE PERIOD AND TERM
This is not an insurance policy.
The SoftCare Pro includes tokens to use on software services. End-user's tokens are good until they are used for software services, returned for refund in accordance with the refund policy listed below, or until End-user leaves the University or College, whichever comes first.

RENEWABILITY
Extra tokens may only be purchased if End-user is adding the tokens to an existing SoftCare Pro Plan.

PLACE AND TIMES OF SERVICE
Service will be provided by UBMicro. End-user must bring their computer to the service counter inside UBMicro located at 109 The Commons, 520 Lee Entrance Road, Amherst, NY 14228. This is on the North Campus of the University at Buffalo. Software services will be performed on End-user's computer only during UBMicro's normal or seasonal business hours. End-user may view a map of UBMicro's location, directions, and UBMicro's present operating hours by clicking here.

WHAT IS COVERED
UBMicro will furnish labor necessary to complete the software services desired by End-user from the Software Services Token Chart as long as End-user has enough tokens on their SoftCare Pro account.

End-user's SoftCare Pro will be tied to one computer serial number. End-user may only use the tokens from their SoftCare Pro on this computer. The computer's serial number must match the computer serial number on record for the End-user's SoftCare Pro Plan.

LIMITATIONS OF COVERAGE
The SoftCare Pro does not cover hardware services which includes, but is not limited to, the purchase of computer components, the installation of hardware components, the cleaning of the fans or case, the reseating of cables or components, or the application of thermal paste. The SoftCare Pro also does not cover the facilitation fee to perform warranty services.

END-USER RESPONSIBILITIES
End-user must supply their own copy of licensed software and the associated valid installation codes. End-user must also supply device driver discs if needed for components and/or peripheral devices.

End-user must present their SoftCare Pro Token Card at the time of any desired software services.

End-user is responsible to make periodic backup copies of all their data stored on their hard drive and other backup storage devices as a precaution against possible failures, alteration, or loss of the data.

When UBMicro copies or transfers End-user's data, End-user must confirm whether the data has been successfully copied or transferred.

Before End-user returns any product for service, End-user must be sure to backup data and remove any confidential, proprietary, or personal information and passwords.

End-user is responsible to pay any and all New York State Sales Tax at the time of services. Tokens from End-user's SoftCare Pro will be used for payment of services, but cannot be used to pay for the applicable sales tax on the services purchased.

LIMITATIONS OF LIABILITY
If End-user's data is altered or lost due to any failure or malfunction of the hard drive or other devices and the data cannot be recovered, UBMicro shall not be liable for any damage or loss of data, or any other damage resulting from service.

UBMicro disclaims any liability for the failure to copy or transfer End-user's data correctly.

UBMicro is not responsible for damage to or loss of any programs, data, or removable storage media.

UBMicro is not responsible for the restoration or reinstallation of any programs or data that is lost due to the failure of End-user's equipment or the nature of UBMicro's repairs.

UBMicro will not under any circumstances be liable for any incidental or consequential damages, including, but not limited to, property damage, lost time, lost data resulting from the breakdown or failure of any equipment or from delays in servicing or the inability to render service on any covered equipment. Exclusion is made of any implied warranty of fitness for a particular purpose. There are no express or implied warranties made herein.

NON-TRANSFERABILITY
End-user's SoftCare Pro is not transferable to another End-user or a different computer. The tokens associated with End-user's SoftCare Pro must be used with the computer's serial number and person id which is tied to the SoftCare Pro at the time of purchase.

CANCELLATION AND REFUND
UBMicro offers a refund if End-user does not use any of their original tokens when End-user leaves the University or College.

Once a refund is given, the SoftCare Pro associated with the refund and all tokens attached to it will become void.

The percentage of the refund is tied to the amount of time the End-user has had their unused tokens based on the following chart:
